WHAT ARE COOKIES AND TRACKING TOOLS IN GENERAL; INFORMATION ON MANAGEMENT AND DEACTIVATION

According to the “Guidelines on cookies and other tracking tools” issued by the Italian Data Protection Authority on June 10, 2021, cookies are small text strings, usually consisting of letters and/or numbers, that websites (so-called publishers or first parties) visited by the user — or different websites or web servers (third parties) — place and store, directly in the case of the former and indirectly in the case of the latter, within a terminal device available to the user.

The reference devices include, for example, a computer, tablet, smartphone, or any other device capable of storing information.

Internet browsing software and the functioning of these devices — such as browsers — can store cookies and then send them back to the websites that generated them during a subsequent visit by the same user, thus keeping a record of their previous interaction with one or more websites.

The information encoded in cookies may include personal data such as an IP address, username, unique identifier, or email address, but may also contain non-personal data such as language settings or information about the type of device a person is using to browse the site.

Cookies can perform important functions, such as session tracking, storing information about specific configurations concerning users accessing the server, and facilitating the use of online content. For example, they can be used to keep track of items in an online shopping cart or information used to fill out an electronic form.

On the one hand, cookies make it possible, among other things, for web pages to load faster and to route information across a network — thus fulfilling functions closely related to the basic operation of websites. On the other hand, cookies can also be used to deliver behavioral advertising, measure the effectiveness of advertising messages, or tailor the type and manner of services provided based on the behavior of users previously observed.

It is important to specify that the purposes typically served by a cookie can also be achieved through other tracking tools and similar technologies that make it possible to identify devices in order to analyze visits to the website.

CLASSIFICATION OF COOKIES AND OTHER TRACKING TOOLS

COOKIES ARE CLASSIFIED BASED ON:

duration: session cookies or persistent cookies;

source: first-party or third-party cookies;

purpose: technical cookies; performance analysis cookies; and behavioral advertising (profiling) cookies.

DURATION: Cookies that expire at the end of a browser session (usually when the browser is closed or the session times out) are defined as session cookies and are useful, for example, to keep the browsing session active. Cookies that, on the other hand, are stored for a longer period of time (between one session and another) are called persistent cookies and are useful, for instance, to remember your preferences or to offer targeted advertising.

SOURCE:

The definition of first-party or third-party refers to the website or domain that installs the cookie. First-party cookies are installed directly by the website, while third-party cookies are installed by a different domain — for example, when the website includes elements from other services, such as advertising platforms.

PURPOSE:

TECHNICAL COOKIES: used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such a service” (Art. 122, paragraph 1 GDPR). The legal basis for processing technical cookies is the legitimate interest of the website owner, which consists of the interest in ensuring the website’s operation and, where applicable, carrying out statistical analysis.

PROFILING COOKIES: used to associate specific actions or recurring behavioral patterns in the use of the features offered (patterns) with identified or identifiable individuals, for the purpose of grouping various profiles into homogeneous clusters of different sizes. This allows the controller, among other things, to tailor the provision of services in an increasingly personalized way, beyond what is strictly necessary for the delivery of the service, as well as to send targeted advertising messages, that is, in line with the user’s preferences expressed while browsing the web. These cookies may only be used with the data subject’s consent, which also serves as the legal basis for their processing. The user must never be forced, without alternative, to give consent to the receipt of cookies or other tracking tools, under penalty of being denied access to the site. Removing or rejecting these cookies will not result in any loss of functionality.

If consent is given, it can be freely revoked at any time by following the instructions contained in this document.

ANALYTICS COOKIES: perform analysis and statistics on website usage and visitor flow. These cookies fall within the category of Technical Cookies if the possibility of directly identifying the data subject (so-called single out) through their use is prevented — meaning that the use of Analytics Cookies that, due to their characteristics, could act as direct and unique identifiers must be disabled.

Analytics Cookies also fall under the category of Technical Cookies when it is considered lawful for the data controller (i.e., the website owner) to carry out statistical analysis directly. This includes the use of statistics relating to multiple domains, websites, or apps belonging to the same controller, provided that such analysis does not go beyond simple statistical aggregation and does not take on the characteristics of processing aimed at making commercial decisions.

This means that third parties (which may, for example, provide web analytics services) must not combine the data (even if minimized) with other processing activities (such as customer files or visit statistics from other websites, for instance), nor transmit them to additional third parties. Doing so would result in an unacceptable increase in the risk of user identification. The only exception is when the statistics they produce, based on minimized data, concern multiple domains, websites, or apps belonging to the same data controller or business group.

The new measures are aligned with the provisions of Article 25, paragraph 1, of the Regulation concerning privacy by design, which aims to “effectively implement data protection principles.” This goal can be achieved through data minimization measures that significantly reduce the identifying power of analytics cookies, particularly when they are used by “third parties.”

The legal basis for processing is that of technical cookies when they fall within this category, or consent when they do not.

HOW TO MANAGE COOKIE PREFERENCES

When you first access any page of the Website, a banner appears containing a short notice and a link that allows you to open the COOKIE CONSENT MANAGER, through which you can easily choose which cookies to enable. You can access the “cookie consents” section at any time via the link available in the Website footer.

ATTENTION: Closing the banner (for example, by selecting the specific command marked with an X at the top right) means that the default settings will remain active, and therefore browsing will continue without cookies or other tracking tools other than technical ones.

In addition to the above, you can also modify your cookie settings directly through your browser, deleting all or some cookies, or restricting their transmission to certain websites. Below are instructions on how to change cookie settings for the most commonly used browsers:

CODING CRITERIA: The following are the criteria by which tracking tools are categorized under predefined categories.

Technical Cookies – always active, except for the user’s right to block them through their browser settings: these cookies are used to ensure the proper functioning of the website. They do not store personal information. Their use does not require the user’s consent. Without these cookies, the website may not function properly. The legal basis for processing these cookies is the legitimate interest in ensuring the correct operation of the website.

Analytics Cookies – always active, except for the user’s right to block them through their browser settings: used to count visits and are necessary to improve the performance of our website. The data is collected in anonymous and aggregated form; therefore, their use does not require user consent. Without these cookies, it is still possible to browse the site without any problems or restrictions. The legal basis for processing data through these cookies is the legitimate interest in improving the website’s performance. However, since the data is anonymous, no personal data processing takes place.

Functionality Cookies: used to simplify navigation, they are necessary to ensure features such as support chat, language selection, search engine functionality, and similar tools.

These cookies may only be used with the user’s consent. Without these cookies, it is still possible to browse the website without any issues or restrictions, except for the inability to use the features that rely on this type of cookie. The legal basis for processing data through these cookies is consent.

Profiling Cookies: used to store user preferences, they are necessary to offer targeted advertising content and more relevant commercial initiatives based on the user’s interests. These cookies may only be used with the user’s consent. Without these cookies, it is still possible to browse the website without any issues or restrictions. The legal basis for processing data through these cookies is consent.

COMMUNICATION AND DISCLOSURE OF DATA

The data collected through the use of cookies may be processed by employees and collaborators in the performance of company functions aimed at pursuing the purposes mentioned above. These individuals have been expressly authorized to process the data and have received appropriate operational instructions. Such data may also be processed by trusted companies that carry out technical and organizational tasks on behalf of the Data Controller. These companies act as data processors.
In particular, within the scope of data processing carried out through the Website, the company responsible for hosting and data backup services for the Website has been appointed as a processor. Additionally, the data may be processed by external parties acting as independent data controllers, such as authorities and supervisory or regulatory bodies.

Personal data may be transferred outside the EU (e.g., to the USA). In such cases, the transfer of data will take place in accordance with the provisions set out in the GDPR, Title V, Articles 44 and following. In particular, the transfer may occur to a third country deemed adequate under Article 45 of the GDPR, in compliance with a decision adopted by the European Commission.
For third countries not subject to an adequacy decision, the transfer may take place based on Standard Contractual Clauses pursuant to Article 46 of the GDPR, after verifying that the third country ensures an adequate level of protection for personal data.

It should be noted, however, that Tracking Tools allow this website to provide users with a better experience and advanced features (in line with the purposes outlined in this document).
